C10 Workplace relations

The Teaching Staff Union Collective Agreement 2007-2009 expired on 30 June 2009. During the reporting period the Department successfully negotiated the new Teaching Staff Enterprise Agreement 2009-2011 which came into effect on 6 November 2009. The Department has established a joint working party with the Australian Education Union (AEU) to oversee implementation of the agreement and examine a range of teacher workload issues.

The Staff Union Collective Agreement 2007-2010 (for non-teaching staff) expired on 31 March 2010. Following negotiation of the ACTPS Common Terms and Conditions the Department will bargain for the new one year Staff Enterprise Agreement 2010-2011. This agreement will expire on 30 June 2011.

During the reporting period, the Department successfully resolved an industrial dispute regarding a proposed AEU moratorium on the 2010 National Assessment Plan – Literacy and Numeracy testing of students in years 3, 5, 7 and 9. An order preventing industrial action was obtained from Fair Work Australia and subsequently referred to the Federal Court. A resolution was reached between the AEU and the Commonwealth Government which resulted in the moratorium being lifted. The dispute had minimal impact on schools.

Special Employment Arrangements and Australian Workplace Agreements

Special Employment Arrangements (SEAs) are made in accordance with the provisions of the relevant Enterprise Agreement or Union Collective Agreement.

SEAs are part of the Department’s attraction and retention strategy, allowing the needs of the Department to be met through the employment of officers with specialist skills and qualifications.

Australian Workplace Agreements (AWAs) made prior to the introduction of the Fair Work Act 2009 will continue to operate until terminated. No new AWAs were made.
